Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, products, and services operated by Torch Solutions Group (“TSG,” “we,” “us,” or “our”), including torchsolutionsgroup.com (collectively, the “Sites”). By accessing or using the Sites or any TSG product or service, you agree to these Terms. If you do not agree, do not use the Sites or services.
1. Eligibility
You must be at least 18 years old and a working professional to use TSG’s services. By using the Sites or purchasing any TSG product or service, you represent that you meet these requirements and have the legal authority to enter into these Terms.
2. Services Offered
TSG provides the following products and services:
Meaningful Competence® Consultant Certification
TSG owns, operates, and administers the Meaningful Competence® Consultant Certification program (the “Certification Program”), including all curriculum, assessments, credentials, and related program materials. Enrollment in and completion of the Certification Program is subject to these Terms and any additional program-specific terms provided at enrollment.
My Value App Access
TSG may provide eligible clients and certification participants with a connection to subscribe to the My Value App (the “App”), a subscription service owned and operated by My Value Applications, LLC, a separate legal entity. TSG does not own, develop, or maintain the App. TSG’s facilitation of App access does not make TSG responsible for the App’s performance, uptime, features, or data practices. Your use of the App is governed by My Value Applications’ own Terms of Service and Privacy Policy. TSG’s license relationship with My Value Applications does not extend TSG’s obligations or liability to you with respect to the App.
Community Group Site
TSG operates one or more online community sites (the “Community”) for subscribers, consultants, and certification participants. The Community is intended as a professional space for sharing insights, resources, and experiences related to identifying, measuring, increasing, and sharing professional value. Access to the Community is a feature of your TSG account and is subject to the Community conduct standards described in Section 6 below.
3. Accounts
You must create a TSG account to access certain products and services, including the Community. Your account may also serve as the connection point for accessing the My Value App if you are enrolled in a plan that includes App access.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access. You may not share your account with others or create accounts on behalf of third parties.
4. Subscriptions and Billing
Certification program fee. Enrollment in the Meaningful Competence® Consultant Certification Program requires payment of the applicable program fee at the time of enrollment. Access to program materials, assessments, and instruction is contingent on receipt and clearance of that payment. Program fees are non-refundable except as required by applicable law.
Free trial. Where offered, TSG may provide a free trial period for new subscribers. No charge is made during the trial period. At the end of the trial, your subscription converts to a paid plan unless you cancel before the trial ends.
Subscription fees. Fees vary by plan and are disclosed at the time of purchase. All fees are in U.S. dollars. Pricing is subject to change with 30 days’ notice.
Payment. You authorize TSG to charge your payment method on the renewal date of each billing cycle.
Cancellation. You may cancel your TSG subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You retain access to your TSG account features through the end of that paid period. Note that cancellation of your TSG subscription does not automatically cancel any separate My Value App subscription, which is managed directly with My Value Applications.
No partial refunds. No refunds are issued for partial billing periods or unused portions of an annual subscription, unless required by applicable law.
Failed payments. If a payment fails, TSG will notify you and may suspend access until payment is resolved.
5. Acceptable Use
You agree not to use the Sites or TSG services to:
• Violate any applicable law, regulation, or third-party rights
• Upload or transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to TSG systems, other accounts, or the Community
• Interfere with or disrupt the integrity or performance of the Sites or services
• Harvest or collect information about other users without their consent
• Upload, post, or share any information that is confidential, proprietary, or trade-secret material belonging to your employer or any other organization, unless you have explicit written authorization from that organization to do so
• Use the Sites or services for any purpose that competes with TSG’s business without prior written consent
You are personally responsible for any content you post or share through TSG’s Sites or Community, including any unauthorized disclosure of confidential information.
6. Community Site Standards
The TSG Community is a professional space. By participating, you agree to the following:
Public Nature of Community Content
Any content you post, share, or upload to the Community—including comments, responses, documents, or other materials—becomes publicly accessible to other Community members and may be visible more broadly. Do not post anything you would not share in a professional public setting. TSG is not responsible for how other users may use or share content you post.
Purpose of the Community
The Community exists to support professional development, peer learning, and the application of the Meaningful Competence® methodology. Posts should support that purpose. Content that is off-topic, promotional for competing products or services, defamatory, harassing, obscene, or otherwise inconsistent with a professional community environment is not permitted.
TSG’s Moderation Rights
TSG reserves the right, in its sole discretion, to review, edit, remove, or restrict access to any Community content that TSG determines violates these Terms, is inconsistent with the purpose of the Community, or is otherwise inappropriate. TSG is not obligated to monitor all Community content but may do so. Removal of content does not necessarily result in account termination, though repeated or egregious violations may.
Your Responsibility for Posts
You are solely responsible for the accuracy, legality, and appropriateness of content you contribute to the Community. TSG does not endorse any user-submitted content. By posting content, you grant TSG a non-exclusive, royalty-free license to display and distribute that content within the Community and in connection with TSG’s promotional materials, unless you request otherwise.
7. Intellectual Property
TSG’s Intellectual Property
The Meaningful Competence® Consultant Certification program, including its curriculum, assessments, tools, methodology, trademarks, and all related materials, is the intellectual property of Torch Solutions Group or its licensors. Nothing in these Terms grants you any right to use TSG’s trademarks, logos, or brand elements without TSG’s prior written consent.
Licensed Intellectual Property
Certain tools and methodology made available through TSG’s services—including elements of the Meaningful Competence® Toolkit—are licensed by TSG from My Value Applications. TSG operates as a licensor of that intellectual property in connection with the Certification Program and related services. Your access to those tools through TSG is subject to both these Terms and any applicable terms from My Value Applications. TSG makes no independent warranties with respect to licensed intellectual property beyond those expressly stated in these Terms.
Certification Credentials
Upon successful completion of the Meaningful Competence® Consultant Certification, TSG will issue a credential or designation to qualifying participants. That credential authorizes the holder to represent themselves as a Meaningful Competence® Certified Consultant and to use TSG’s associated marks as permitted under Section 7.
Annual Maintenance Fee
Maintaining an active Meaningful Competence® Consultant Certification requires payment of an annual maintenance fee. The fee amount is disclosed at the time of certification and is subject to change with 30 days’ notice. The maintenance fee is due annually on the anniversary of your original certification date.
If the annual maintenance fee is not received by the due date, your credential will move to lapsed status. A lapsed credential holder may not represent themselves as an active Meaningful Competence® Certified Consultant or use the associated credential marks until the credential is reinstated. TSG will provide written notice of lapsed status by email.
A lapsed credential may be reinstated within two (2) months of the lapse date by paying the outstanding maintenance fee. Reinstatement restores the credential in good standing without requiring re-enrollment in or completion of the Certification Program. If the reinstatement window expires without payment, the credential is permanently lapsed and re-certification through full program enrollment and completion is required to obtain a new credential.
Annual Maintenance Fee
TSG reserves the right to revoke a certification credential, in its sole discretion, for any of the following causes:
• Misrepresentation of certification status, including claiming to hold an active credential when the credential is lapsed, revoked, or was never earned;
• Improper use of TSG trademarks, logos, certification marks, or other intellectual property, including use on unapproved materials or in contexts that misrepresent the Meaningful Competence® methodology;
• Fraudulent or materially false statements made during the certification process or in connection with the use of the credential;
• Conduct that brings TSG or the Meaningful Competence® methodology into disrepute, as determined by TSG in its reasonable judgment;
• Material violation of these Terms or TSG’s code of conduct for certified consultants.
Prior to revocation, TSG will provide written notice by email describing the basis for revocation and allowing ten (10) days for the credential holder to respond. TSG will consider any response in good faith before making a final determination. Revocation is effective upon written notice of TSG’s final decision. A revoked credential holder must immediately cease use of all TSG credential marks and designations. Revocation does not entitle the credential holder to a refund of any fees paid.
8. Third-Party Services
TSG’s Sites and services may integrate with or link to third-party websites, tools, or services, including the My Value App. TSG does not control and is not responsible for the content, practices, or policies of third-party services. Your use of any third-party service is governed by that service’s own terms and privacy policy. TSG’s facilitation of access to a third-party service does not constitute an endorsement of or warranty for that service.
9. Disclaimer of Warranties
THE SITES AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TSG DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TSG DOES NOT WARRANT THAT THE SITES OR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. TSG MAKES NO WARRANTIES WITH RESPECT TO ANY THIRD-PARTY SERVICE, INCLUDING THE MY VALUE APP, ACCESSED THROUGH OR IN CONNECTION WITH TSG’S SERVICES.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TORCH SOLUTIONS GROUP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITES OR SERVICES, OR FROM ANY CONTENT YOU POST IN THE COMMUNITY. TSG’S AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED THE TOTAL FEES YOU PAID TO TSG IN THE 12 MONTHS PRECEDING THE CLAIM. TSG IS NOT LIABLE FOR DAMAGES ARISING FROM YOUR USE OF THE MY VALUE APP OR ANY OTHER THIRD-PARTY SERVICE.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas without regard to conflict of law principles. Any dispute arising from these Terms or your use of TSG’s Sites or services shall be resolved in the state or federal courts located in Texas, and you consent to personal jurisdiction there.
12. Changes to These Terms
TSG may update these Terms from time to time. TSG will provide at least 14 days’ notice of material changes by email or website notice. Your continued use of the Sites or services after changes take effect constitutes your acceptance of the updated Terms.
